We, ANCİENDA TEKNOLOJİ YAZILIM VE PAZARLAMA A.Ş., residing at Selimpaşa Mah. 1010. Sk. No:10/1 İç Kapı No: 1 Silivri / İSTANBUL, TURKEY ("Ancienda", "us", "we", or "our"), place great importance on your privacy. This Privacy Policy applies to the apps and website of Ancienda and their various and future versions (hereinafter collectively referred to as the "Service") and is incorporated into and subject to our Terms of Use. This document also serves as a Privacy Notice in accordance with applicable data protection laws, including the Turkish Law on the Protection of Personal Data No. 6698 ("KVKK").

Your use of the Service signifies that you agree with the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use the Service.

Data protection laws can vary from country to country. Depending on your place of residence, you may have additional rights or be entitled to further information, as described in this policy.

A. WHAT DATA DO WE COLLECT?

We, Ancienda, are committed to protecting your personal data and taking all necessary steps to ensure that it is processed only in accordance with your requests. You do not have to provide us with the personal data we request, but if you choose not to, we may not be able to offer you our products or services.

The personal data we collect from you may include:

Your name, correspondence address, phone number, date of birth, email address, search inquiries, technical data such as URL, IP address, and information in your profile.

User-generated content (e.g., photos, screenshots, comments, and other materials) that you create on the Service.

Face data from images you upload to use face-swapping features can be processed by specialized third-party providers strictly for generating the requested effect. These providers are obligated to use the data only for this purpose and are prohibited from storing or reusing it. Face data will only be used for the functionality of the Service (e.g., applying visual effects or face-swapping) and will never be used for profiling, marketing, or identity verification. We may temporarily keep a copy to improve feature accuracy, which is automatically deleted within 180 days.

If the Service crashes or hangs, we collect error-reporting information so that we can investigate the error and improve the stability of the Service for future releases. These reports do not contain personally identifiable information, or only incidentally. As part of these error reports, we receive information about the type and version of your device, the device identifier, the time the error occurred, the feature being used and the state of the application when the error occurred. We do not use this information for any purpose other than investigating and fixing the error.

We do not knowingly collect personal data from children. Parental/guardian consent is required for users under the age of 18 in Turkey. For users in the European Union, consent is required for users under the applicable national age of consent (which varies between 13 and 16). If you are under the applicable age limit, please do not use Ancienda services without obtaining parental/guardian consent.

B. HOW AND ON WHAT LEGAL BASIS DO WE COLLECT YOUR DATA?

We collect and process your personal data based on the legal grounds set forth in applicable laws, such as Article 5 and 6 of the KVKK and Article 6 of the GDPR. These legal bases include:

Your Explicit Consent: In cases where your consent is legally required, such as for processing special categories of personal data like your face data or for sending marketing communications, we will only process your data based on your freely given consent obtained via an opt-in mechanism.

Performance of a Contract: When the processing of your personal data is necessary for the establishment or performance of our user agreement with you.

Compliance with a Legal Obligation: When we process your data to comply with our legal obligations.

Our Legitimate Interests: When processing is necessary for our legitimate interests, such as improving our Service, analyzing error reports, and preventing fraud, provided that these interests are not overridden by your fundamental rights and freedoms.

Cookies and Similar Technologies:

Currently, our Service uses only technically essential cookies required for its basic functionality. If we decide to use analytics, advertising, or other non-essential cookies in the future, we will not place them on your device without first obtaining your explicit, opt-in consent in line with applicable laws such as GDPR and KVKK.

C. TO WHOM DO WE TRANSFER YOUR DATA?

We may transfer your personal data to the following parties:

Affiliates: Businesses that are legally part of the same group of companies as Ancienda.

Service Providers: Third-party organizations that help us provide the Service to you under reasonable confidentiality terms.

International Data Transfers and Third-Party Service Providers

As a global company, we work with third-party service providers and partners. Therefore, your personal data may be transferred to and processed in countries other than your own. When we conduct these international data transfers, we take the utmost care to ensure the security of your data and act in full compliance with applicable data protection laws, particularly Article 9 of the Turkish Law on the Protection of Personal Data (KVKK) and Chapter V of the GDPR.

For transfers originating from Turkey, we use the Standard Contractual Clauses published by the Turkish Data Protection Authority (KVKK Board) or other approval mechanisms as stipulated by the Board. For transfers subject to the GDPR, we use legal instruments that provide appropriate safeguards, such as the EU Standard Contractual Clauses (SCCs), or transfer data to countries recognized by the relevant authorities as providing an adequate level of data protection.

D. PROTECTION OF PERSONAL DATA

Ancienda implements various administrative, internal, and technical security measures to protect your personal data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

If you accessed a website, product or service provided by a third party, including through the Service, such third party may also collect information about you. Please see the privacy policies of each such third party for more information about how they use the information they collect. This Privacy Policy does not apply to any exchange of information between you and any third party.

E. HOW LONG DO WE KEEP YOUR DATA?

Unless a longer retention period is required or permitted by law, we will retain your personal data for the time necessary to fulfill the purposes outlined in this Privacy Policy.

General user data (e.g., account details, contact info) is retained as long as your account remains active and thereafter only as required by law.

Face Data is retained strictly for up to 180 days from its creation, after which it is permanently deleted, unless a longer retention period is legally required (e.g., to comply with law enforcement requests).

F. YOUR RIGHTS

Your Regional Data Protection Rights

1. Your Rights for Residents of the Republic of Turkey (Under the KVKK)

If you reside in Turkey, you have the following rights under Article 11 of the Law on the Protection of Personal Data by applying to the Data Controller:
  • to learn whether your personal data are processed or not;
  • to request information if your personal data are processed;
  • to learn the purpose of the processing of your personal data and whether these personal data are used in compliance with the purpose;
  • to know the third parties to whom your personal data are transferred in-country or abroad;
  • to request the rectification of the incomplete or inaccurate data, if any;
  • to request the erasure or destruction of your personal data under the conditions laid down in Article 7;
  • to request notification of the operations carried out in compliance with subparagraphs (e) and (f) to third parties to whom your personal data has been transferred;
  • to object to the processing, exclusively by automatic means, of your personal data, which leads to an unfavorable consequence for you;
  • to request compensation for the damage arising from the unlawful processing of your personal data.

2. Additional Rights for Residents of the European Economic Area (EEA), United Kingdom, and Switzerland (Under the GDPR)

If you reside in one of these regions, you have the following rights under the General Data Protection Regulation (GDPR) in addition to the rights above:

Right to Restriction of Processing: You can ask us to restrict the processing of your personal data under certain circumstances.

Right to Data Portability: You have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format and to transmit that data to another controller.

Right to Object: You may object to the processing of your personal data based on our legitimate interests. If you object to processing for direct marketing purposes, we will immediately stop processing your data for such purposes.

Right to Lodge a Complaint with a Supervisory Authority: If you believe our data processing activities are in breach of the GDPR, you have the right to lodge a complaint with the data protection authority in your country of residence.

3. Additional Rights for Residents of California (Under the CCPA/CPRA)

If you are a consumer residing in California, you have specific rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to delete that information, and the right to opt-out of the "sale" or "sharing" of your personal information.

We may review this Privacy Policy from time to time. The most current version will always be available on this page. By continuing to access or use the Service after changes become effective, you agree to be bound by the revised Privacy Policy.
